General Terms and Conditions of business
(Information and service center Panometer Leipzig)

1. Area of Validity

These General Terms and Conditions of Business are valid for all products and events offered by the Panometer Leipzig as well as asisi Panorama Berlin. These General Terms and Conditions of Business form the contractual basis of a visit to the Panometer Leipzig are an integral part of the contractual relationship between the operator (Panometer GmbH) and the service recipient (the visitor(s) or organizer of the group of visitors).

2. Completion of Contract and Booking

When a booking is made with the Visitor Services Dept., the service recipient agrees to the General Terms and Conditions of Business. As soon as the service recipient receives our written confirmation, his/her booking is binding and a contract with Panometer GmbH has been entered into. In the case of events where advance booking is required, reservations are processed in the order in which they are received. If Panometer GmbH is unable to accommodate a booking, this will be communicated to the service recipient. In the case of events for children and young people, please observe age restrictions.

3. Payment Procedures

The prices offered for guided tours are subject to the reduced turnover tax rate (currently 7 per cent) in accordance with § 12 Abs. 2 Ziffer 7.lit a) UStG. In exceptional cases, with prior written confirmation, it is possible for an invoice to be issued to companies. If a group price has been agreed for a guided tour and fewer participants than expected take part on the day of the visit, the full price is still payable. The number of entrance tickets issued will be reduced accordingly.

4. Services/ Changes in Service / Cancellations

The extent of the contractual services is derived from the service description given in the booking/order confirmation from Panometer GmbH. Any additional agreements must be confirmed in writing by Panometer GmbH.
Services (group visits and guided tours) are subject to a no-charge cancellation deadline of 5 calendar days before the point of service for the service recipient. Cancellations must be made in writing by fax under the number +49(0)341.35 55 34-0 or by e-mail to service(at)panometer.de. If a cancellation reaches us after the cancellation deadline has expired, a cancellation fee to the value of the full agreed price is payable (applicable for guided tours and gastronomic services). The same is applicable in the case of non-attendance at the agreed time of the event. The time of cancellation is defined as the time at which it is received by the central Visitor Services Dept. of the asisi Panometer. The burden of proof lies with the service recipient.
In the case of visitors arriving late for a guided tour which has been booked in advance, the tour guide will wait a maximum of 20 minutes from the time when the tour was scheduled to begin. This is on condition that we are informed of the late arrival by telephone under the number +49(0)341.35 55 34-0 (Panometer Leipzig).
The service recipient has no claim to the guided tour being carried out once the waiting period has elapsed. The service recipient is obliged to bear the full cost of the service. In other cases of late arrival, the tour will be shortened accordingly and finish at the scheduled time.
The confirmation of gastronomic services is binding for the invoice on the day of the visit. A cancellation deadline of 5 calendar days before the time of the agreed service applies. After the deadline has elapsed, a cancellation fee of the full gross value is payable. We accept no liability if the event cannot take place due to acts of God.

5. House Regulations

The house regulations and conditions of use of Panometer Leipzig as well as asisi Panorama Berlin apply.

6. Liability

Panometer GmbH is liable only in the case of malicious intent and gross negligence. Legal liability for damage resulting from injury to life, body or health remains unaffected. In these cases, Panometer GmbH bears liability for every degree of responsibility.

7. Offsetting and Right of Retention

A setting off against claims made by Panometer GmbH is permitted only in the case of undisputed or fully legally established claims.

8. Withdrawal of the Organiser

If there is no other written agreement to the contrary, Panometer GmbH is entitled to withdraw from the contract at any time by means of a written declaration of withdrawal.

9. Data Protection

Panometer GmbH is entitled to acquire, save and process the data required to carry out the business transaction in accordance with the valid data protection laws. All personal data is handled with utmost confidentiality.
Personal data is acquired only if it is provided by the service recipient for the purposes of contract fulfilment. The personal data submitted for this purpose is used exclusively for the fulfilment of the contract and in response to the requests of the service recipient. Data is passed on to third parties, associated enterprises and partner enterprises only if this is essential in order to fulfil the contract. In particular, the data of the service recipient is not used for advertising purposes. The data submitted by the service recipient is used exclusively for the fulfilment and processing of his or her order.
Once the contract has been completed and payment has been made in full, the data is blocked for any other use and deleted after expiration of all provisions according to tax and commercial laws. The service recipient has the right to always receive information at no charge and concerning his or her stored personal data and, if applicable, a right to have such data corrected, blocked, or deleted. 10. Applicability of German Law

The contractual relationship is governed exclusively by German law; the place of fulfilment is the place where the services are provided. The binding contractual language is German.

11. Severability Clause

If parts of these General Terms and Conditions of Business are invalid, the validity of the remaining provisions is not affected.

12. Final Clause

These General Terms and Conditions of Business of Panometer GmbH are valid from 01.01.2016.
